Likeness Policy

1. What this covers

To make your AI avatar, MemoryMatch.ai (run by Yarkii LLC) asks for three photos of you — your face straight on, your face turned slightly, and your full body — and a 3-second video of you blinking and turning your head. In this policy these are called your Originals.

Everything MemoryMatch.ai creates from your Originals with AI — your avatar, and every image, video, scene or other content made using it — is called AI Content.

2. You own your Originals, and we never show them

You keep ownership of your Originals. We store them privately on our own systems. We never display, publish, sell or share them as they are, and we never show them on your profile or anywhere else on the site — including to you: you can review each photo on your phone before you submit it, but once submitted, your Originals cannot be viewed or downloaded from your account. If the law gives you a right to a copy, email us and we will provide one.

Everything shown on MemoryMatch.ai is AI-generated. What you will see of yourself is your avatar sheet, made by AI from your Originals.

We use your Originals only to create your avatar, to check that the person in the photos is you, and to improve how well your avatar resembles you.

3. MemoryMatch.ai owns the AI Content

By agreeing, you assign to Yarkii LLC all rights, title and interest in the AI Content, including copyright. MemoryMatch.ai owns the AI Content and may use, copy, change, combine, publish, distribute, display and license it, in any media, worldwide, for any purpose, including to promote MemoryMatch.ai, without paying you or asking you again.

This continues after you close your account, for AI Content that already exists at that time.

To the extent you have rights in your name, likeness or voice as they appear in the AI Content, you grant MemoryMatch.ai a worldwide, perpetual, irrevocable, royalty-free licence to use them in and with the AI Content as described above.

4. What we will not do with your avatar

We will not use your avatar or AI Content in sexually explicit material, to depict you committing a crime, or to make it appear that you personally said or endorsed something in order to mislead people about you.

We will not present AI Content as a real photo or video of you. AI Content on MemoryMatch.ai is labelled as AI-generated.

5. Face and body data (biometric information)

Creating and checking your avatar involves analysing the geometry of your face in your Originals, and reading your body from your full-body photo: estimated height and weight, build and proportions. In this policy all of this is called your face and body data. Some laws, including the Illinois Biometric Information Privacy Act, treat face data as biometric information. This section is our written notice and our retention policy for your face and body data.

Purpose: we collect and use face and body data only to create your avatar and to confirm that the person in the photos is you.

Retention: we permanently delete your Originals and any face and body data derived from them when you delete your avatar or close your account, and in any case within three years of your last interaction with MemoryMatch.ai, whichever comes first.

We never sell, lease, trade or otherwise profit from your face and body data. We disclose it only to the service providers that process it on our behalf to make your avatar (for example our AI image provider), under terms that protect it, or where the law requires.

By checking the box below you give your written release to the collection, storage and use of your face and body data as described here.

6. Your promises

You are at least 18 years old. The person in the Originals is you, and nobody else appears in them. You are not uploading anyone else's pictures.

7. Deleting

You can ask us to delete your Originals and your avatar at any time by emailing [email protected]. We will delete your Originals and face and body data as described in section 5 and stop creating new AI Content from your avatar. AI Content that already exists remains MemoryMatch.ai's, as described in section 3.

8. Changes

If this policy changes, we will ask you to read and agree to the new version before creating any new AI Content from your Originals.
